Your Disclaimer is not even legal!
« on: February 01, 2004, 06:05:40 am »
Hahaha, who wrote your disclaimer??? a 5 year old kid? So your disclaimer protects this site under US law? Who are u trying to kid?

US Law would not protect a site that is taking apart the code which is property of games developers so that cheat programs can be made. You dont even own the code so you have no right to stop games companies coming into your site.

Quote from the disclaimer
Quote
You will be held responsible for violating art.7. Of the US Human Rights by denying us the rights of our civil liberties.

What about my human rights to enjoy a game as it was originally intended that is getting spoiled by cheaters coming onto the server that I pay for? It is my civil liberty to enjoy the game as it was intended and it is Codemaster and Bis' liberty to sell as many games as they can. If players hear that OFP/Vietcong is just full of cheaters then you are denying the games companies of selling more games.

Quote
No content on this website is or contains material protected by copyright, trademark, trade secret or other intellectual property right used without proper authorization

Any game that you wish to make cheats for is copyrighted and have trademarks so YOU are the people using their program without the proper authorization.

Quote
We do not post or condone defamatory, scandalous, or private information about a person without their consent, intentionally inflicting emotional distress, or violating trademarks, copyrights

Again see the above explanation to see why your disclaimer is complete ballony

If you are altering a games code so that you can cheat then all games companies associated with that game are more than within their rights to come onto this site and see how you have altered their game code.

Also considering that nothing has to be ticked or signed to enter this site your disclaimer is useless because one of the games companies could have just been sent a link straight into your forum and bypassed the front page with the disclaimer on.

Just because you used some big words in your disclaimer (which you probably ripped from another site) doesnt make it legal at all.

How dumb do you guys think we are? Its like selling drugs on here and having a disclaimer proclaiming 'This site is not open to drug squad officers, the police, the FBI, the CIA, SWAT, Mi5 or any other drug related police enforcement. This site does not condone the selling of drugs even though we talk about it and tell you where to get it or how to use them.

Hehehehehehehehehe... please write another one as I havent had such a good laugh in a long time!

Oh yeah, You DO post private information about a persons work without their consent and you intentionally inflict emotional distress on ALL the people at ALL the games companies that you write cheats for because you post cheats here and those people have to then go and work out a way around the new cheat and then release a new patch.

Any form of going into a game, opening up raw code and altering it is not only inflicting emotional stress, it is violating copyright laws and violating terms of use.

Well, to make cheats for a game isn't against the copyright. It is if you take materials from the game and publish it as your own or without permission from codemasters.

It's BIS' work to prevent the cheats, it's their job. If they have made an insecure version of the game they got to fix it naturally.

It's everyones right to play the game as he wants to and if it's possible.
However it's the server owners decision whom to block etc.

Thats like a theif saying 'dont blame me for breaking into your house because you didnt bother to install an alarm.'

I see you want to ban me from here and the reason for that is because you havent got a reply have you! You cannot defend this website or your disclaimer because non of it is legal.

Perhaps I should be the one reporting this site to your ISP?

And if you want to get all legal and technical on me then perhaps you could take a couple of minutes to read the Codemasters Software Company Ltd Software License Agreement that is printed in the back of your OFP handbook.

Here is a snippets from it:

Quote
You Shall Not:
* Reverse engineer, derive source code, modify, decompile, disassemble, or create derivative works of the program, in whole or in part.

Considering that you guys are trying to quote the Gospel here in regards of Disclaimers, perhaps you would like to take note of the above before even writing yours!

Anyone who wants to come and defend themselves after seeing the above clause must realise before typing anything here that you agreed with this clause when you installed OFP - and the Codemasters agreement is legally binding.

So, are there any Sherlocks out there who want to further defend the disclaimer on this site as not breaking copyright rules?

Who cares what it says INSIDE the box?

Did anybody tell you BEFOR you paid for it....and owned it?

Here in the USA people have gone to court over these things.....some have won.

How can you OWN something and THEN be made to enter a contract to install what you own?

It goes againt all known CONTRACT LAW.

*While we crash and burn, small, low tech, agrarian societies such as the Hmong in the mountains of Laos will continue on without so much as blinking an eye.*

Right, I don't see that we do any of your listed things. Even if we did noone can proove it, as we do not host any source files or copyrighted items on the site.
You know it's not illegal to discuss something, it's the freedom of speech.
And what you read is for educational purposes only also.

On the other side, you are threatening people and suppressing a minority with different thoughts. Which is illegal.

The disclaimer is in many parts as legal as gamelicenses.

What about the ID changer and spam program??? Arent they source files then?

I could ask the same about this site asking people to agree to a disclaimer that asked the visitor to agree with whatever is on this site even before they have the chance to enter and see what is actually here.

The law I quoted is just the same as owning a car but not being able to drive it until you get your license or are insured.

Go look in your downloads section - specifically the ID changer and spam tool. The source code had to be opened and adjusted to find out how to change an ID for starters.

Anything that you read and gain knowledge from is an education, so your argument falls flat right there. Then you go on to contradict yourself by first claiming 'You know it's not illegal to discuss something, it's the freedom of speech.', then go onto say 'you are threatening people and suppressing a minority with different thoughts. Which is illegal.'

So what happened to this marvelous freedom of speech all of a sudden? Either I am allowed to express free speech or Im not? It cant be both?

The ID changer simply works in the programs memory, it's not actually part of the program, it's a thried party program that alters the programs in-game memory when it is running. THere is no permaneant alteration ot the games code, there is no reverse engineering. There is no profit. What we are doign is as legal as a program that would, say, color your name or something like that.
Innocence proves nothing

THe programs are no alterations of source code. Don't make hasty accusations about things you don't know anything about.

Threats are not included in freedom of speech. Racial remarks aren't either.

Freedom of Speech = Say what you want unless you "threat" or hurt anyone.
